    ABOUT “TO_MO”

    “TO_MO” is an integrated mobile application designed to support youth services, developed collaboratively by Hong Kong non-profit youth service organisations and is funded by The Hong Kong Jockey Club Charities Trust. The application aim to serve young people in Hong Kong aged 10-24, by offering four core services: guidance and counselling, supportive services for young people in disadvantaged circumstances, socialisation programmes and programmes for the development of social responsibility and competence.


    The projects (collectively, the “Projects”) under “TO_MO” include:

    The following organisations (collectively, “Operating Organisations”, “We”, “us”, “our”) are participating (in alphabetical order):

    These terms and conditions apply to your use of this online platform “TO_MO”.


    USE OF THE “TO_MO” PLATFORM

    Anyone (including the Operating Organisations and the platform users) who uses “TO_MO” must read these Terms and Conditions. By using or accessing “TO_MO”, you are deemed to have agreed to these Terms and Conditions and the Privacy Policy Statement and Personal Information Collection Statement available on this platform.


    Please note that you may be subject to separate terms when you participate in activities or events offered by particular Operating Organisations and/or other third parties (collectively, “Organisers”). You should read and agree to such terms before participating in the programmes.



    You may contact us by email at vp01@jc21c.net, if you have any questions about these Terms and Conditions and the Privacy Policy Statement and Personal Information Collection Statement. If you do not agree to these Terms and Conditions and the Privacy Policy Statement and Personal Information Collection Statement, you may not use “TO_MO” and may consider using other youth services.


    If you are under 18 years old, please first consult with your parents/guardians and obtain their consent before you access or use “TO_MO” and/or provide any consent to us.


    1. SERVICES OF “TO_MO”

    1. 1.1. Sharing of Information: “TO_MO” provides information on various services offered by the Organiser and displays photos and videos showcasing the activities offered, facilities and venues.
    2. 1.2. Registration and Booking: Some activities, facilities and venues can be registered or booked through “TO_MO”, while some only accept offline registration or booking.
    3. 1.3. Chat and Interact: You may communicate with other users through the interactive features of “TO_MO”.
    4. 1.4. Member-Exclusive Services and Features: Certain services and features (such as activity registration) are only available to registered members of “TO_MO”. You must sign up and create an account (the “TO_MO Account”) in order to access and utilize these member-exclusive services and features. Some services and features are reserved for the registered members of a particular Project only. Therefore, you may also be required to register as a member of and create an account for the relevant Project (the “Project Account”). (The “TO_MO” Account and the Project Account are collectively referred to as the “Accounts” hereinafter.)
    5. 1.5. We reserve the absolute right and discretion to add, change, suspend or discontinue any services or features from time to time without prior notice to you. We shall not be liable for any of your loss resulting from the use or inability to use any services or features of “TO_MO”.

    6. 2. PRIVACY POLICY

      1. 2.1. Your privacy and security are very important to us. We ensure that the collection, use, storage, erasure, transfer and access to personal data under “TO_MO” service comply with the requirements of the Personal Data (Privacy) Ordinance, (Cap. 486). For more details, please refer to our Privacy Policy Statement and Personal Information Collection Statement.
      2. 2.2. If you are located outside of Hong Kong, any information you provide will be collected from or transferred to Hong Kong and be used in accordance with Hong Kong laws. Our information and data are stored and maintained in our electronic database, facilities, servers and back-up servers which may be located outside of your country. These locations may have data protection and security requirements that are not equivalent to those in your jurisdiction. By providing your information, you expressly consent to the transferring, storing, maintaining and retaining all your information and data in such locations for the purposes referred to in the Privacy Policy Statement and Personal Information Collection Statement.

      3. 3. ACCOUNT REGISTRATION AND USAGE

        To maintain a safe environment for using “TO_MO”, you understand and agree to the following:

        1. 3.1. All acts performed in your Accounts in “TO_MO” will be deemed to have been done by you, and you may be liable for corresponding legal responsibilities.
        2. 3.2. You will not let others use your Accounts for whatever purposes.
        3. 3.3. You will not disclose your password to others.

        4. 4. CONTENT AND INFORMATION

          1. 4.1. When you are sharing content and information, you must ensure that you have the right or authorization for public dissemination, display or broadcasting of such content and information concerned and will not infringe the rights of any third party in any way.
          2. 4.2. For the content wherein intellectual property rights subsist, such as photos and videos, when you are sharing such content on “TO_MO”, you are deemed to have unconditionally grant us and our assigns and successors-in-title an irrevocable, perpetual, royalty-free and worldwide license to modify, publish and use such content for all archival and promotional purposes. In relation to any part of the content to which you are not empowered to grant the aforesaid license, you undertake to procure the grant of such license for the benefit of us and our assigns and successors-in-title by the relevant intellectual property rights owners.
          3. 4.3. Any reproduction, adaptation, distribution or dissemination of any information available within “TO_MO” for commercial use is strictly prohibited unless prior written authorization is obtained from us.
          4. 4.4. The administrator of “TO_MO” reserves the right to delete any content and information being posted by you that is in breach of these Terms and Conditions.
          5. 4.5. Any content contained in “TO_MO” does not constitute our view, recommendation and/or endorsement.
          6. 4.6. The administrator of “TO_MO” has the right to monitor the text and images uploaded by users from time to time. If you discover any inappropriate content, please report it through the in-app reporting feature or email the administrator at vp01@jc21c.net.

          7. 5. YOU AGREE NOT TO USE “TO_MO” FOR THE FOLLOWING PURPOSES:

            1. 5.1. Upload, post, email, transmit or otherwise disseminate any content that contains personal data (such as the identity card number or personal contact information) of any third party, or internal or confidential information of any company, organisation or association;
            2. 5.2. Upload, post, email, transmit or otherwise disseminate any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
            3. 5.3. Harm other people in any way;
            4. 5.4. Impersonate any person, group or entity, or falsely state or otherwise misrepresent your affiliation with a person, group or entity;
            5. 5.5. Use, upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other rights of any party; upload, post, email or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation, except in those areas that are designated for such purpose;
            6. 5.6. Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
            7. 5.8. Interfere with or disrupt “TO_MO” or servers or networks connected to “TO_MO”, or disobey any requirements, procedures, policies or regulations of networks connected to “TO_MO”;
            8. 5.9. Intentionally or unintentionally violate any applicable local, national or international law or regulation;
            9. 5.10. Stalk or otherwise harass another;
            10. 5.11. Accessing or attempting to access other users' Accounts;
            11. 5.12. Tampering with communications which are not yours, or making any alteration to any information on “TO_MO”; and/or
            12. 5.13. Extract, collect, process or store personal data about other users.

            13. 6. TERMINATION OF ACCOUNTS


              1. 6.1. If your “TO_MO” Account remains inactive for a continuous period of one year after you reach the age of 25 years old, your “TO_MO” Account, together with your Project Account(s) (if any) will be terminated.
              2. 6.2. In the event that “TO_MO” ceases to operate or any specific Project is no longer available on “TO_MO”, your “TO_MO” Account (together with your Project Account(s) (if any)) or your Project Account for that Project will be terminated, as the case may be.
              3. 6.3. If you are in breach of these Terms and Conditions or have engaged in any inappropriate behaviour, we may immediately terminate your “TO_MO” Account and/or Project Account(s) and/or block your access to and use of “TO_MO” and/or the Project(s).
              4. 6.4. You may terminate your “TO_MO” Account by notifying us via “TO_MO”. If you terminate your “TO_MO” Account, your Project Account(s) will also be terminated simultaneously.
              5. 6.5. If any of the events described in Clauses 6.1 to 6.3 occur, all affected users will also be notified by email.
              6. 6.6. After the termination of the Account(s), all enrollments and payments made before the termination of the Account(s) will remain valid, and no refund can be arranged. You will no longer be able to retrieve or log into such an account. Any personal data or other information collected by us during your use of “TO_MO” and/or during your use of the services and features provided by the relevant Project(s) will be handled in accordance to our Privacy Policy Statement and Personal Information Collection Statement.

              7. 7. THIRD PARTY LINKS

                1. 7.1. “TO_MO” may contain links to other websites, resources, and advertisers. Links to “TO_MO” from other mobile applications or websites maintained by third parties or from “TO_MO” to other mobile applications or websites maintained by third parties do not constitute our endorsement of any third-party application, website or content. We shall not be responsible for these third-party resources, or their contents. You acknowledge that we have no control over, and make no representations of any kind with respect to, such other mobile applications, websites or any content contained within such other mobile applications or websites. Your linking to other third-party application or websites is at your own risk.
                2. 7.2. You should direct any concerns regarding any third-party link to us.

                3. 8. YOU SHOULD ALSO PROTECT YOURSELF

                  1. 8.1. Despite the procedures and security features that we have implemented to prevent unauthorized access to user data, the Internet remains an imperfectly secure environment, and we cannot guarantee protection from intruders or interceptors. You agree to use “TO_MO” and submit information at your own risk. You agree that we or any of the Operating Organisations will have no liability regarding unauthorized access.
                  2. 8.2. While we make a reasonable effort to ensure the accuracy and completeness of the content or information available on “TO_MO”, we do not guarantee that it is free from defects, errors, omissions, viruses or anything which may change, erase, add to or damage your software, data or equipment, or that messages sent through the Internet will be free from interception, corruption or loss. We shall not accept any responsibility for any loss or damage arising from the content or information available on “TO_MO” or your download, reproduction or re-dissemination of any content or information from “TO_MO”. In addition, you should back up any necessary data and documents you provided to “TO_MO”, we shall not hold liable for any loss of data and documents.
                  3. 8.3. When you enrol in and attend any activity available on “TO_MO”, you acknowledge and accept all associated risks. We disclaim all liabilities to the maximum extent permitted by the applicable law. If you have any questions about an activity, you should contact the relevant Organiser directly. We do not have control over activities that are not organised by us.

                  4. 9. REGISTRATION AND BOOKINGS OF ACTIVITIES, FACILITIES AND VENUES

                    1. 9.1. Before registering or booking any activities, facilities, or venues through “TO_MO”, you must also read the relevant terms and conditions carefully, including but not limited to the participant's eligibility, insurance coverage and refund policies. By registering and booking activities, facilities, or venues through “TO_MO”, you are deemed to have agreed to such terms and conditions, assessed all the associated risks and agreed to assume all such risks.
                    2. 9.2. Please note that various activities, facilities, and venues may be provided by different Organisers. We have not entered into any agreements with you regarding the activities, facilities, and/or venues that are not provided by us, nor do we act as intermediaries or agents. We are not responsible for supervising the Organisers (if the Organiser is not one of the Operating Organisations) and do not assume any liability for any illegal acts, breaches of contract, negligence, or misconduct by individual Organisers (if the Organiser is not one of the Operating Organisations). Under no circumstances shall we be liable for your losses or damages incurred directly or indirectly, as a result of your participation in activities organised by third parties or your use of third-party facilities or venues.
                    3. 9.3. Some venues may have CCTV or cameras installed, and some Organisers may take photos of the activities for promotional purposes. If you have any concerns or questions, please contact the relevant Organiser directly.

                    4. 10. MODIFICATION OF TERMS AND CONDITIONS

                      1. 10.1. These Terms and Conditions may be modified from time to time without notice. Any changes will be effective immediately upon posting. Every time you access the Service of “TO_MO”, you may refer to the most recent version of the Terms and Conditions. Your use of the “TO_MO” after any modification of the Terms has been posted will constitute your acceptance of the revised Terms and Conditions.

                      2. 11. GOVERNING LAW

                        1. 11.1. These Terms and Conditions are governed solely by and shall be construed according to the laws of Hong Kong without giving effect to principles of conflict of law. You agree to the exclusive jurisdiction of the Hong Kong courts over all matters and disputes arising out of or in connection with these Terms and Conditions.

                        2. 12. SEVERABILITY: ENTIRE AGREEMENT

                          1. 12.1. If a court finds any provision of these Terms and Conditions to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and the remaining terms shall remain in full force and effect. These Terms and Conditions constitute the entire agreement between you and us, superseding any other written or oral agreements or understandings.

                          2. 13. LANGUAGES

                            1. 13.1. If the English version and Chinese version of these Terms and Conditions are inconsistent, the English version shall prevail.
